Statutes
In accordance with the principles laid down in the Constitution of the Italian Republic, a technical-professional association called the Associazione Italiana Gemmologi is established, bringing together gemmologists holding a qualification awarded by private or public training bodies and institutes, who practise the free profession of gemmologist, even on a non-continuous basis.
For the purposes of these statutes, the profession of gemmologist means the professional activity of ascertaining and identifying the nature, species and variety of gemstones or, more generally, of materials of gemmological interest, issuing a written and signed certificate or making statements, including oral ones, in public.
Association
Regulations
Gemmologists who hold the relevant diploma from an Italian or foreign training body may become members.
Acceptance of the membership application is subject to approval by the Executive Board. If the applicant graduated from a training body unknown to the Executive Board, the Board will verify the validity of the qualification.
To be admitted as a member of the Associazione Italiana Gemmologi, the applicant must submit the application on the form prepared by the Executive Board, together with all the documents referred to in Article 6 of the Statutes.
The application will be examined by the Executive Board, which will decide by majority after the necessary checks.
Acceptance will be communicated to the applicant together with the stamp and the delivery record, which must be countersigned and returned to the secretariat.
It is the task of the Executive Board to establish and keep up to date the Register of member gemmologists.
Governing bodies
Executive Board
The Executive Board has 8 members, serves for a three-year term and its members may be re-elected. The Board is elected by the General Assembly of members. Each member may cast no more than 8 votes. The eight candidates who obtain the most votes are declared elected.
The Executive Board in turn elects from among its members the five members of the presidential committee: the President, the Vice President, the Secretary, the Treasurer and the Rapporteur.

Board of Arbitrators
The Board of Arbitrators (Collegio dei Probiviri) consists of three members elected by the Assembly of members. Members serve for three years and may be re-elected.
The Board of Arbitrators is responsible for applying disciplinary measures and for settling any dispute between members, or between members and the Association, that is referred to it.
The Board of Arbitrators acts as an informal arbitrator (arbitrato irrituale) and its decisions are binding and not open to appeal.
Disciplinary measures
- 1 a written warning
- 2 a reprimand (censure)
- 3 suspension from the Association for a period of six months to two years
- 4 expulsion
Read the disciplinary procedure
Where expulsion is envisaged, the presidential committee is competent to rule at first instance, on referral by the Board of Arbitrators; the right to appeal to the Executive Board, as provided in Art. 11, is preserved. The decision taken by the Executive Board is final and not open to appeal.
A member of the Association who fails to behave professionally, with fairness and good faith, in carrying out their activity as a gemmologist will be referred to the Board of Arbitrators, also on the initiative of a single member, after notifying the Executive Board. The Board of Arbitrators, where the grounds exist, applies by reasoned judgment – without prejudice to Art. 34 (expulsion procedure) – the sanctions set out in Art. 35 of these statutes. Expulsion also applies to a gemmologist whose conduct has seriously damaged their own reputation and the dignity of the profession.
No disciplinary penalty may be imposed unless the person concerned, after being notified of the charges, has been invited to appear before the Board of Arbitrators, with a period of not less than thirty days, in order to be heard. The person concerned may be assisted by a defence counsel. If they fail to appear, or submit no written defence and show no legitimate impediment, the proceedings will go ahead in their absence.
The Board of Arbitrators must complete the fact-finding procedure and reach its decisions within 120 (one hundred and twenty) days of the matter being referred to the Association. Having heard the person concerned and examined any statements or documents, the Board decides by a majority of its members.
Decisions are taken in writing, communicated to the Chair of the Executive Board and notified by the latter to the person concerned by registered letter with return receipt and/or certified email (PEC). The same rules that apply to proceedings before the Board of Arbitrators apply to expulsion proceedings before the Executive Board.
Governing bodies
Auditors
The administrative management of the Association is overseen by the Auditors, three of whom are full members and two alternates; they serve for three years and may be re-elected.
The Auditors are elected by the General Assembly of members using the same procedure as the members of the Executive Board, and choose a chair from among themselves. If a full auditor leaves office for any reason, the eldest alternate takes over.
The Auditors have the right to attend meetings of the Executive Board without a deciding vote and act as tellers in Assemblies where voting is by ballot; they also form the electoral committee at the end of each term.

Rules
Code of ethics and conduct
The conduct of member gemmologists must be consistent with the dignity and decorum of the profession they practise, including outside their professional activity.
The code of ethics and conduct is a code of ethics and behaviour that all members of the Associazione Italiana Gemmologi are required to follow, in order to preserve and enhance the reputation, competence and professionalism of gemmologists. Its rules are binding on all members.
Members must refrain from any conduct that could bring the profession or the Association itself into disrepute.
Failure to comply with the rules of conduct set out in this Code of Ethics will be punished with the disciplinary sanctions provided for in the Statutes and the Regulations. Article 33 of the Statutes provides for the establishment of the Board of Arbitrators.
